Welcome to My Hoardings!

These Terms and Conditions ("Terms") govern your access and use of My Hoardings ("we," "our," "us"), an online platform that connects media owners with media buyers for seamless media transactions, including listing, contracting, and payments.

By using our platform, you agree to comply with these Terms. If you do not agree, please refrain from using our services.

1. Definitions

• My Hoardings: The online platform operated by My Hoardings that connects media owners and media buyers.
• Media Owner: A user who lists and offers advertising spaces for sale.
• Media Buyer: A user who purchases advertising spaces through My Hoardings.
• User: Any individual or entity that registers on My Hoardings, including both Media Owners and Media Buyers.
• Services: The platform’s functionalities, including listing, purchasing, contracting, and payments.

2. Eligibility

• Users must be at least 18 years old and capable of entering legally binding agreements.
• Businesses registering on My Hoardings must provide valid company registration details (where applicable).
• We reserve the right to refuse or terminate accounts if eligibility requirements are not met.

3. Registration and Account Management

• Users must create an account and provide accurate, complete, and up-to-date information.
• You are responsible for maintaining the confidentiality of your account credentials.
• My Hoardings reserves the right to suspend or terminate accounts for violations of these Terms.

4. Services Offered

My Hoardings provides a platform for:

• Media Owners to list advertising spaces, set pricing, and manage bookings.
• Media Buyers to browse, purchase, and manage media campaigns.
• Contracting and Invoicing
• Payment processing to facilitate secure transactions.

My Hoardings does not own any media space listed by Media Owners.

5. Listing Requirements for Media Owners

• Media Owners must ensure all listings are accurate, truthful, and compliant with applicable laws.
• Prohibited content includes misleading descriptions, fraudulent listings, or illegal advertisements.
• My Hoardings reserves the right to remove or modify any listings that violate our policies.

6. Booking and Contracting Process

• When a Media Buyer books a media space, contracts are automatically generated between respective partied involved in the transaction.
• Media Buyers and Media Owners are bound by the terms specified in their respective contracts with My Hoardings.

7. Payment Terms

• Media Buyers must adhere to the payment terms specified when placing their orders.
• My Hoardings will accept payments on behalf of Media Owners.
• Payments to Media Owners will not commence until 30 days after proof of flighting (i.e., proof that the advertisement has been placed or displayed as agreed).
• Payment timelines will be subject to verification of the advertising campaign’s execution.
• My Hoardings may withhold payments in cases of disputes or non-compliance with terms.
• My Hoardings may charge a service fee on transactions (details provided at checkout).

8. Cancellations and Refunds

• Media Buyers may cancel orders subject to the cancellation terms of the Media Owner.
• Refunds will only be issued in cases where the Media Owner fails to deliver the advertising service as agreed.
• If a refund is approved, payments will be processed within 15 business days.

9. User Obligations

Media Owners must:

• Provide accurate and legal listings.
• Honor confirmed bookings and contracts.
• Comply with advertising regulations and intellectual property laws.

Media Buyers must:

• Ensure payments are made promptly.
• Provide all necessary materials for advertising placements.
• Adhere to the agreed-upon advertising schedule.

Users must not use My Hoardings for fraudulent activities, money laundering, or any illegal transactions.

10. Intellectual Property Rights

• My Hoardings retains all rights, trademarks, and intellectual property related to the platform.
• Users may not copy, modify, or distribute My Hoardings’s content without permission.
• Media Owners must have the legal right to sell and advertise the media spaces listed.

11. Liability and Disclaimers

• My Hoardings does not guarantee the quality, effectiveness, or legality of media spaces listed by Media Owners.
• We are not liable for any disputes arising between Media Owners and Media Buyers.
• My Hoardings is not responsible for business losses, indirect damages, or third-party fraud.

12. Dispute Resolution

• Any disputes between My Hoardings and users shall first be resolved through internal dispute resolution procedures.
• If disputes cannot be resolved internally, they may be referred to arbitration in accordance with the laws of the Federal Republic of Nigeria.

13. Privacy and Data Protection

• My Hoardings collects and processes user data in compliance with GDPR and NDPR.
• By using our platform, you consent to our Privacy Policy.

14. Termination of Accounts

My Hoardings reserves the right to:

• Suspend or terminate any account that violates these Terms.
• Take legal action against fraudulent users.

Users may also terminate their accounts by sending a request to our support team.

15. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.

16. Amendments to Terms

My Hoardings may update these Terms periodically. Users will be notified of significant changes via email or platform notifications.
